Mercer County Homicide Task Force Investigation Leads to Arrest of Trenton Man for Shooting Homicide

EWING TWP (MERCER)– Mercer County Prosecutor Angelo J. Onofri reported today that an investigation by the Mercer County Homicide Task Force and the Ewing Police Department has led to the arrest of a Trenton man for Monday’s murder of Cedric Hennessee Flippin in Ewing Township.

Daryl K. Smith, 30, was arrested Thursday afternoon at Newark Liberty International Airport on an airplane departing for North Carolina by members of the U.S. Marshals Service. He is charged with first-degree murder, second-degree possession of a weapon for an unlawful purpose, two counts of unlawful possession of a weapon and second- degree certain persons not to possess a firearm. The prosecutor’s office has filed a motion to detain Smith pending trial.
At approximately 7:30 p.m. on November 29, 2021, Ewing police were dispatched to Public Storage on Parkside Avenue in Ewing. Officers arrived on scene and located Flippin unresponsive on the ground outside of one of the storage lockers. Detectives located a shell casing nearby and Flippin was pronounced dead at the scene.

Despite having been charged, every defendant is presumed innocent until found guilty beyond a reasonable doubt in a court of law.

Investigation Results in Drugs and Gun Arrest

On Wednesday August 28, 2019 while working a Directed Enforcement Detail coordinated with a Drunk Driving Enforcement Detail (DDEF), officers and detectives assigned to the detail received information of possible narcotics activity at the Jackson Premium Outlets located off of Monmouth Road.

While conducting surveillance in the area, officers observed the suspect vehicle enter the parking lot and conducted a motor vehicle stop with it. As the three occupants of the vehicle were being secured, officers observed the front seat passenger of the vehicle attempting to reach for his waistband before complying with their orders. As he was taken into custody, a Beretta M9 9mm handgun was recovered from the front area of his waistband. The gun was secured and discovered to have a 15 round magazine which was fully loaded.

During a further search of the vehicle, five bricks of heroin (in excess of 2 ounces) packaged for sale was also recovered. The 3 male suspects were placed under arrest and the 2005 Ford van they were in was impounded pending forfeiture proceedings.

Arrested:

Daryl Smith, age 27 of Trenton NJ. He was charged with: possession of heroin and possession of heroin with the intent to distribute.

Cedric Hennessee-Flippin, age 27 of Trenton NJ. He was charged with: possession of heroin, possession of heroin with the intent to distribute and possession of a controlled dangerous substance while operating a motor vehicle.

Zaire Jackson, age 25 of Trenton NJ. He was charged with: possession of heroin, possession of heroin with the intent to distribute, unlawful possession of a weapon, possession of a weapon for an unlawful purpose, possession of a weapon while in possession of a controlled dangerous substance with the intent to distribute, possession of hollow point bullets and possession of a magazine capable of holding in excess of 10 rounds.

All three arrested were processed and later lodged in the Ocean County Jail.

In addition to this incident, other officers working the evening detail, which also included Ocean County Sheriff’s Officers, conducted 69 motor vehicle stops, issued 45 summonses and impounded 2 vehicles.

– The media and the public are reminded that any persons arrested or charged with any offenses or crimes are presumed innocent until proven guilty in court.

Worker Dies in 25 Feet Fall at Cranbury Warehouse

CRANBURY, NJ (MIDDLESEX)–Police and EMS were dispatched to Delta Apparel Inc, 5 Santa Fe Way, Suite 501, Cranbury, NJ 08512 on December 2, 2021 at 11:46 a.m. for a reported fall victim. On arrival, Police located Cesar Torres, a 34yo male from Hackensack NJ, atop an interior warehouse floor with a severe head injury. Robert Wood Johnson Hospital Paramedics, along with the Cranbury Township First Aid, transported Torres to Robert Wood Johnson Hospital (New Brunswick). Torres was subsequently pronounced dead while at the hospital.

The investigation revealed that Torres, an employee for WA Installation (Passaic NJ), was elevated within the warehouse, approximately 25 feet up, installing warehouse shelving racks, immediately prior to the accident. Next of Kin has been notified. The incident remains under investigation with the Cranbury Township Police Department and OSHA.


Governor Murphy Announces Support For Comprehensive Gun Safety Bill Package in Current Legislative Session

METUCHEN, NJ (MIDDLESEX) – As part of his ongoing commitment to meaningfully address the nation’s gun violence crisis, Governor Phil Murphy today urged legislators to take action in the coming weeks and pass a comprehensive gun safety legislative package that was initially proposed by the Governor in April. If passed by the Legislature and signed into law, the bill package discussed today would be the third wide-ranging gun safety package signed by the Governor since taking office. The Governor also thanked Assembly Speaker Craig Coughlin for his commitment to posting the package during the current legislative session. Among the measures are reforms that would ensure firearms are handled safely, provide additional tools to law enforcement, and regulate school shooting drills.

The Governor was joined for the announcement by Speaker Coughlin, Senator Pat Diegnan, Assemblywoman Joanne Downey, Acting Attorney General Andrew J. Bruck, and gun safety advocates.

“Over the past four years, New Jersey has become a national leader on gun safety,” said Governor Murphy. “We must continue to build on that progress and make our state safer for the over nine million people who call New Jersey home. Today, I am proud to further commit to this goal, and I hope to work with my Legislative partners to take this step by the end of this legislative session. I thank Speaker Coughlin, Senate Majority Leader Loretta Weinberg, Assembly Majority Leader Lou Greenwald, and other legislative partners for their continued commitment to gun safety.”

In partnership with the Legislature, Governor Murphy has already taken significant steps to combat the epidemic of gun violence. Among other things, New Jersey has established a “red flag” law for gun violence protective orders; criminalized firearms trafficking; strengthened background checks; reduced the maximum capacity of ammunition magazines; banned “ghost guns;” established the Rutgers Gun Violence Research Center to identify evidenced-based solutions to the gun violence crisis; and established a partnership with a coalition of states (New York, Pennsylvania, and Connecticut) to share crime gun data between law enforcement agencies.

“Supporting this bill package alongside the Governor today, represents just the latest installment in our ongoing effort to lead the nation on fair and robust common-sense gun safety laws,” said Assembly Speaker Craig J. Coughlin. “Essential training, better tracking of firearms and ammunition, safer storage, and stronger policy to stem the flow of out-of-state guns into New Jersey are how we keep our communities safe. Governor Murphy today recommitted to the following additional reforms:

Ensuring Firearms are Handled Safely

  • Requiring Firearm Safety Training:  S-2169/A-5030 (Weinberg/Reynolds-Jackson) would modernize firearm ID cards, as well as require completion of a firearm safety course to receive a permit to purchase a gun or receive a firearm ID card. 
  • Mandating Safe Storage of Firearms:  Gun owners would be required to store guns in a lockbox or gun safe. 

Making New Jersey Safer

  • Banning .50 Caliber Firearms: S-103/A-1280 (Gill/Greenwald) would revise the definition of “destructive device” under New Jersey law so that it includes weapons of .50 caliber or greater. 
  • Closing Loophole for Importing Out-of-State Firearms:  A-3686/S-372 (Vainieri Huttle/Cryan) would require firearm owners who move to New Jersey to obtain a firearm purchaser identification card (FPIC) and register their firearms within 30 days of residing in this State.  

Giving Law Enforcement the Tools to Address Gun Violence

  • Establishing Electronic Ammunition Sales Recordkeeping:  A-1292/S-1481 (Greenwald/Weinberg) would require manufacturers or dealers of handgun ammunition to keep a detailed electronic record of ammunition sales, and report ammunition sales to the State Police. 
  • Promoting Microstamping Technology:  S-112/A-1098 (Weinberg/Downey) would require within a year that firearm manufacturers incorporate microstamping technology into new handguns sold in New Jersey, providing law enforcement with a tool to quickly link firearm cartridge casings found at the scene of a crime to a specific firearm, without having to recover the firearm itself.   

Additional Actions

  • Regulating School Shooting Drills:  New Jersey schools currently are required to conduct active shooter exercises but guidelines are not specific about how those drills should be conducted.  The Governor proposes authorizing the Department of Education to establish trauma-informed and age-appropriate standards for lockdown drills.
  • Holding the Gun Industry Accountable:  In New Jersey, almost 80% of guns used in crimes are originally purchased outside of the state.  However, the gun industry has failed to take any steps to stem the flow of guns to the illegal market through gun shows, flea markets, straw purchasers, and theft.  The Governor proposes amending the state’s public nuisance laws to prohibit the gun industry from endangering the safety or health of the public through its sale, manufacturing, importing, or marketing of guns.  


Tinton Falls, Monmouth County, NJ, Man who is a Previously Convicted Felon Charged with Impersonating DEA Agent and Possessing Handgun at a Hospital in Red Bank

TRENTON, NJ (MERCER) – A Monmouth County, New Jersey, man was arrested today for impersonating a federal agent and illegally possessing a firearm as a convicted felon, Acting U.S. Attorney Rachael A. Honig announced.

Wesley Rucker, 34, of Tinton Falls, New Jersey, is charged by complaint with one count of possession of a firearm by a convicted felon, one count of impersonating a federal agent, and one count of possession of an imitation badge. He is scheduled to appear this afternoon by videoconference before U.S. Magistrate Judge Tonianne J. Bongiovanni.

According to documents filed in this case and statements made in court:

On Oct. 22, 2021, Rucker sought treatment in the emergency room of a Red Bank, New Jersey, hospital. Hospital personnel noticed that Rucker had a handgun in his waistband. Rucker told hospital security personnel that he was a member of law enforcement and displayed a Drug Enforcement Administration (DEA) identification. Hospital security had Rucker store his handgun in a locker in the hospital’s security office. Hospital personnel contacted the Red Bank Police Department after becoming suspicions of Rucker’s claimed affiliation with federal law enforcement. Responding officers confronted Rucker, and he told the officers that he was a “DEA agent.” Rucker displayed the same DEA identification to the officers. As the officers were investigating Rucker’s claims, Rucker attempted to leave the hospital without his handgun. Officers took Rucker into custody and seized the fake identification along with a fake DEA badge that Rucker had not used. Officers learned that Rucker was a previously convicted felon who had no prior affiliation with the DEA.

The felon in possession of a firearm charge carries a maximum penalty of 10 years in prison and a fine of up to $250,000. The impersonation of a federal agent charge carries a maximum penalty of three years in prison, and a fine of up to $250,000. The possession of an imitation badge charge carries a maximum penalty of six months in prison, and a fine of up to $5,000.

Acting U.S. Attorney Honig credited special agents of the Bureau of Alcohol, Tobacco, Firearms, and Explosives, Newark Field Division, Trenton Field Office, under the direction of Special Agent in Charge Jeffrey L. Matthews; officers of the Red Bank Police Department, under the direction of Chief Darren McConnell; members of the Monmouth County Prosecutor’s Office, under the direction of Acting Prosecutor Lori Linskey; special agents of the DEA, under the direction of Special Agent in Charge Susan A. Gibson; and officers of the Old Bridge Police Department, under Acting Chief Joseph P. Mandola Jr., with the investigation leading to the charges.

The government is represented by Special Assistant U.S. Attorney Christopher Matthews of the U.S. Attorney’s Office’s Criminal Division in Trenton.

The charges and allegations contained in the complaint are merely accusations, and the defendant is presumed innocent unless and until proven guilty.

Asbury Park Man Indicted for Two Home Invasions, Sexual Assault and Possession of Weapons for Unlawful Purpose

FREEHOLD, NJ (MONMOUTH)A Monmouth County Grand Jury has returned a 13-count indictment against an Asbury Park man for 2 home invasions which occurred in the same town, Acting Monmouth County Prosecutor Lori Linskey announced.

On November 30, 2021, a Monmouth County Grand Jury indicted Shawn Connolly, 34, in relation to two home invasions in the City of Asbury Park, where the defendant also resides.  Connolly was indicted for 2 counts of first degree Armed Robbery, 2 count of first degree Aggravated Sexual Assault, 2 counts of second degree Burglary, 2 counts of third degree Terroristic Threats, 3 counts of third degree Possession of a Weapon for an Unlawful Purpose, and 2 counts of fourth degree Unlawful Possession of a Weapon.

On September 14, 2021, at approximately 5:27 am, members of the Asbury Park Police Department responded to a residence in the city in response to an open 911 line. Upon arrival, Asbury Park police learned that the victims suddenly awoke to Connolly in their home with a knife in his hand threatening to harm them.   During the course of the robbery, one of the victims was sexually assaulted by Connolly. The Asbury Park Police Department found Connolly still at the scene when they arrived and he was placed under arrest.

While this investigation was still underway, the Asbury Park Police Department received another report from an additional victim that her home had been broken into earlier that same morning at approximately 2:30 a.m.  This victim reported that she awoke to a man threatening her with a knife. Connolly was identified as the suspect in this home invasion as well.

If convicted, the defendant is facing up to 20 years in state prison on each count of Armed Robbery as well as the Aggravated Sexual Assault, up to 10 years state prison on each count of Burglary, up to 5 years state prison for each count of Terroristic Threats and Possession of a Weapon for an Unlawful Purpose and up to 18 months state prison for each count of Unlawful Possession of a Weapon.  Additionally, he would be subject to Parole Supervision for Life and would be required to register under Megan’s Law.

The defendant remains incarcerated.

Defendant is currently represented by John M. Murphy, III, Esq., of Staten Island, New York.  The case is assigned to Monmouth County Assistant Prosecutor Danielle Zanzuccki.

Despite these charges, every defendant is presumed innocent, unless and until found guilty beyond a reasonable doubt, following a trial at which the defendants have all of the trial rights guaranteed by the U.S. Constitution and State law.

Eight Indicted on Charges Involving Child Sex Abuse Materials

FREEHOLD, NJ (MONMOUTH)–A Monmouth County grand jury this week returned indictments against two defendants charged with crimes involving distribution and/or possession of child sexual abuse materials, bringing the total number of indictments of this kind over approximately the last month to eight, Acting Monmouth County Prosecutor Lori Linskey announced Thursday.

Two of the eight defendants have been charged with first-degree crimes, the most serious applicable offenses under state law.

Indicted on Tuesday were:

  • Jonathan W. Cruz, 38, of Aberdeen, arrested January 2020 and indicted on charges of first-degree Endangering the Welfare of a Child via Distribution of Child Sexual Abuse Materials using a File-Sharing Program Available to Others and first-degree Endangering the Welfare of a Child via Possession of Child Sexual Abuse Materials; and
  • Neil Ridgway, 58, of Howell, arrested April 2019 and indicted on charges of third-degree Endangering via Possession of Child Sexual Abuse Materials.

Indicted earlier this fall were:

  • Michael Pipitone, 39, of Middletown, arrested in September 2020 and indicted on charges of first-degree Endangering via Distribution of Child Sexual Abuse Materials using a File-Sharing Program Available to Others and second-degree Endangering via Possession of Child Sexual Abuse Materials;
  • Charles Hoagland, 57, of Hazlet, arrested in November 2020 and indicted on three counts of second-degree Endangering via Distribution of Child Sexual Abuse Materials and one count of second-degree Endangering via Possession of Child Sexual Abuse Materials;
  • David Eidman, 53, of Long Branch, arrested in November 2020 and indicted on two counts of second-degree Endangering via Distribution of Child Sexual Abuse Materials and single counts of third-degree Endangering via Possession and third-degree Attempted Endangering;
  • Carl Aliwalas, 29, of Neptune Township, arrested in May 2021 and indicted for second-degree Endangering via Distribution of Child Sexual Abuse Materials and second-degree Endangering via Possession of Child Sexual Abuse Materials; and
  • John Coluzzi, 33, of Manalapan, arrested in May 2021; and Marvin Diaz, 35, of Howell, arrested in November 2019; both were indicted for second-degree Endangering via Distribution and third-degree Endangering via Possession of Child Sexual Abuse Materials.  

Additionally, earlier this fall, 40-year-old Kenneth Megill of Wall Township, arrested in January 2020, was indicted on charges of third-degree Attempted Endangering the Welfare of a Child and third-degree Attempted Obscenity to a Minor for allegedly engaging in inappropriate conversations with and attempting to show inappropriate materials to a juvenile.

Investigations into the actions of these defendants were conducted by members of the Prosecutor’s Office’s Internet Crimes Against Children (ICAC) Task Force, working in tandem with representatives of local police departments in the jurisdictions in which the crimes took place. The cases are assigned to Monmouth County Assistant Prosecutor Stephanie Dugan.

The Monmouth County ICAC Task Force includes members of the following police departments: Bradley Beach, Eatontown, Howell, Long Branch, Manalapan, Marlboro, Middletown, Neptune Township, Spring Lake, Spring Lake Heights, Tinton Falls, Keyport, Keansburg, Belmar, Holmdel, and Red Bank; the Task Force also receives investigative support from the New Jersey State Police (High Tech Crime Bureau).

Convictions on first-degree criminal charges are commonly punishable by terms of 10 to 20 years in state prison. Second-degree convictions can result in terms of 5 to 10 years; third-degree convictions can result in terms of 3 to 5 years.

Despite these charges, every defendant is presumed innocent, unless and until found guilty beyond a reasonable doubt, following a trial at which the defendant has all of the trial rights guaranteed by the U.S. Constitution and State law.
